Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Mortis mobile application or website (collectively, the "Service") operated by Mortis ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.


1. Eligibility

You must be at least 13 years old to use Mortis. If you are between 13 and 18 years old (or the age of majority in your jurisdiction, whichever is higher), you may only use the Service with the consent of a parent or legal guardian. By using the Service you represent that you meet these requirements.


2. Accounts

You may be required to create an account to access certain features. You are responsible for:

Notify us immediately at support@nonmagic.app if you suspect unauthorized use of your account. We are not liable for losses resulting from unauthorized access where you failed to keep your credentials secure.


3. Subscriptions and Payments

3.1 Free Tier

Mortis offers a free tier with access to a limited selection of frequencies and core features. No credit card is required to access the free tier.

3.2 Pro Subscription

Pro features, including AI-personalized sessions, the full 132-frequency library, and advanced HRV analytics, require an active Pro subscription. Subscriptions are offered on a monthly or annual basis and are billed through the Apple App Store.

3.3 Billing and Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID will be charged at the rate shown at purchase. You can manage and cancel your subscription in iOS Settings → Your Name → Subscriptions.

3.4 Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple's standard refund process at reportaproblem.apple.com. We do not process refunds directly.

3.5 Price Changes

We reserve the right to change subscription pricing. We will provide at least 30 days' notice of any price increase, and you may cancel before the increase takes effect.

5. Health and Safety Disclaimer

Mortis is a wellness application, not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease, disorder, or medical condition.


6. Intellectual Property

All content in the Service, including audio tracks, session scripts, frequency compositions, UI design, and software code, is owned by or licensed to Mortis and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.


7. User Content

If you submit content to the Service, including voice recordings, community posts, or feedback, you grant Mortis a worldwide, royalty-free, sublicensable license to use, process, and display that content solely for the purpose of providing and improving the Service. You retain ownership of your content.

You are solely responsible for the content you submit. You represent that you have all necessary rights to grant this license and that your content does not violate any law or third-party rights.


8. Third-Party Services

The Service integrates with third-party services including OpenAI, Anthropic, ElevenLabs, Apple HealthKit, RevenueCat, and PostHog. Your use of those integrations is also governed by the respective providers' terms of service. We are not responsible for third-party services or their data practices.


9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

We do not warrant that the Service will meet your requirements, that audio frequencies will produce any particular result, or that any data (including HRV data) will be accurate or reliable.


10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MORTIS AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.


11. Indemnification

You agree to indemnify, defend, and hold harmless Mortis and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.


12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other business reason. You may terminate your account at any time from Profile → Settings → Delete Account in the app.

Upon termination, your right to use the Service ceases immediately. Sections 6, 9, 10, 11, and 13 survive termination.


13. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring claims in small claims court if eligible.

Class Action Waiver: You agree to resolve disputes with us on an individual basis only. You waive any right to participate in class-action lawsuits or class-wide arbitration against Mortis.


14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notification or email at least 15 days before the change takes effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
